Gibb-Macdougall provides the following services:

Recovery of commercial debts – commercial debts are debts which arise between one business and another.

Demand letters – a demand letter or letter of warning is always sent as the first step in the process at no cost to the client.

Phone calls – when there is no response to demand letters calls are made in an effort to negotiate a settlement.

Litigation – involves the commencement of legal proceedings, obtaining judgment and enforcing judgment. Litigation is undertaken on behalf of clients where there is no response to demand letters & phone calls.

At any point during the processes between the sending of a demand to the enforcement of a judgment a debtor/defendant could either pay in full or agree to pay by instalments.

Online searches – searches are necessary for two reasons, a) to locate debtors who have absconded and b) for the purposes of litigation, for example, to find out whether or not a corporation is in liquidation, in receivership or under administration.

Process Servers – even though the Civil Procedures Act allows us to serve various legal processes by mail we prefer to use process servers to serve documents. Process servers are in a position to learn much more by being physically present.

Reporting – we report regularly regarding the status of a matter depending on the stage it has reached from demand letter to the enforcement of a judgment.

Commission – it is on a sliding scale depending on the size of the debt.

Legal costs – recoverable Court fees are billed to the client together with a small agency fee charged for preparing the legal process. Solicitors costs are only billed where a matter is defended or in a case where our solicitor is required to prepare terms of settlement after a defence has been filed.

Any unrecoverable costs such as our commission is offset by recoverable statutory interest.

Instalments – any instalment offer made by a debtor is put to the client first before being accepted.
